1. Acceptance of Terms

By accessing or using Speechtherapist.app (the “Service”), operated by SpeechLP, Inc. (“we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Speechtherapist.app is a HIPAA-compliant practice management tool for speech-language pathologists (SLPs). The Service provides AI-generated clinical notes, patient management, session recording and transcription, progress analytics, and live monitoring features.

3. Eligibility

The Service is intended for licensed speech-language pathologists, speech therapy assistants, and clinical supervisors. By using the Service, you represent that you are a qualified healthcare professional or are operating under the supervision of one.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must immediately notify us of any unauthorized access to your account
  • You are responsible for all activities that occur under your account
  • You must not share your account with other individuals

5. HIPAA Compliance

5.1 Your Obligations

As a covered entity or business associate under HIPAA, you are responsible for ensuring your use of the Service complies with HIPAA regulations, including obtaining patient consent before recording sessions and maintaining appropriate access controls.

5.2 Our Obligations

We act as a Business Associate under HIPAA. We maintain administrative, technical, and physical safeguards to protect PHI, including encryption at rest and in transit, audit logging, and access controls. See our BAA and HIPAA Compliance pages for details.

6. AI-Generated Content

The Service uses artificial intelligence to generate clinical notes, reports, and suggestions. You acknowledge that:

  • AI-generated content is a clinical aid, not a substitute for professional judgment
  • You are solely responsible for reviewing, editing, and approving all AI-generated content before use in clinical records
  • We do not guarantee the accuracy, completeness, or clinical appropriateness of AI-generated content

7. Assessments, Exercises & Intellectual Property Disclaimer

7.1 Independent Development

All assessments, exercises, activities, scoring rubrics, and related materials available through the Service (collectively, “Assessment Tools”) are independently developed by SpeechLP, Inc. They are not affiliated with, derived from, licensed by, endorsed by, or otherwise connected to any proprietary clinical testing system, standardized assessment publisher, or test development organization, including but not limited to Pearson Clinical, Pro-Ed, Western Psychological Services (WPS), Riverside Insights, Houghton Mifflin Harcourt, the American Speech-Language-Hearing Association (ASHA), or any other third-party publisher of standardized speech-language pathology assessments.

7.2 No Standardized or Diagnostic Claims

The Assessment Tools are not standardized, norm-referenced, or criterion-referenced diagnostic instruments. They have not been validated through independent psychometric research. They do not replicate, reproduce, adapt, or derive from any proprietary test content, stimulus materials, scoring algorithms, normative data sets, or administration procedures belonging to any third-party publisher. The Assessment Tools are general-purpose clinical practice aids only.

7.3 Not a Substitute for Professional Judgment

The Assessment Tools are intended to supplement — not replace — formal evaluation by a licensed speech-language pathologist. Results should be interpreted as general clinical insights only and must not be used as the sole basis for clinical diagnosis, eligibility determination, individualized education program (IEP) decisions, treatment planning, or any other clinical or educational determination.

7.4 User Responsibility

You, the licensed clinician, assume full professional responsibility for selecting appropriate assessment instruments, interpreting results within the context of a comprehensive evaluation, and ensuring that any clinical decisions comply with applicable professional standards, state licensure requirements, and federal and state regulations. SpeechLP, Inc. makes no representations or warranties regarding the clinical validity, reliability, sensitivity, or specificity of the Assessment Tools.

7.5 No Infringement Intended

Any resemblance between the Assessment Tools and any proprietary clinical instrument is coincidental. SpeechLP, Inc. respects the intellectual property rights of all assessment publishers. If you believe that any material available through the Service infringes your intellectual property rights, please contact us at legal@speechtherapist.app and we will promptly investigate and take appropriate action.

7.6 Limitation of Liability for Assessment Tools

To the maximum extent permitted by applicable law, SpeechLP, Inc. disclaims all liability arising from the use of, reliance on, or inability to use the Assessment Tools, including without limitation any claims of clinical misdiagnosis, delayed diagnosis, intellectual property infringement, or adverse clinical outcomes. You agree to indemnify, defend, and hold harmless SpeechLP, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Assessment Tools or your failure to conduct independent standardized evaluations where clinically indicated.

8. Subscription and Billing

The Service offers a Professional plan at $20/month with a 14-day free trial. No credit card is required for the trial period. After the trial, a paid subscription is required for continued access. You may cancel at any time through the Stripe Billing Portal. See our pricing page for current details.

9. Data Ownership

You retain all rights to your data, including patient records, session data, and clinical notes. We claim no ownership of your content. Upon account termination, you may request a full export of your data.

10. Prohibited Uses

  • Using the Service for any unlawful purpose
  • Attempting to access other users' data
  • Reverse engineering or decompiling the Service
  • Using the Service to store data unrelated to clinical practice
  • Sharing PHI through the Service without proper authorization

11. Limitation of Liability

To the maximum extent permitted by law, SpeechLP, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy and HIPAA requirements.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.
